Labor candidate Brian Owler refuses to release legal advice despite eligibility questions

The Nationals revealed this week they had commissioned advice from prominent Sydney silk Geoffrey Kennett, QC – the same barrister who advised Dr Phelps – which concluded that a pharmacist was ineligible to sit in Parliament.
The pharmacy owner in question had nominated to run for a federal seat, but withdrew after receiving the advice, which is understood to have concluded that her role in administering the Pharmaceutical Benefits Scheme was such that it formed an “agreement” with the Commonwealth under section 44(v).
Paediatrician Mike Freelander was forced to resign from his position at Sydney’s Campbelltown Hospital before running for Labor in the marginal, Liberal-held seat of Macarthur at the 2016 election, after receiving similar advice.
Professor Owler said he would have to resign from his position at Westmead Children’s Hospital before lodging his nomination when the government calls an election.
But, he said, “I’m still going to practice in some way. It’s important to me, and the only reason I’ve been able to embark on this process is the fact that I know that I can continue to do that.”
