Setback for George Miller in Mad Max legal action against Warner Bros

Oscar-winning director George Miller has had a setback in his legal action against Warner Bros over unpaid earnings from Mad Max: Fury Road.
The state’s top court has overturned a Supreme Court ruling that the dispute be heard in NSW, as Miller had wanted, and found the Hollywood studio is entitled to battle it out with the Australian filmmaker in California.

A three-judge bench of the NSW Court of Appeal, headed by Chief Justice Tom Bathurst, has ruled that an arbitration clause in the agreement to make Fury Road meant the case should be heard under Californian law.
The court found that Justice David Hammerschlag had erred in his interpretation of the clause.
Miller and producer Doug Mitchell’s production company, Kennedy Miller Mitchell, had argued that the “standard terms” in the agreement were those of the Australian offshoot, Warner Bros Feature Productions Pty Ltd, rather than the parent Hollywood studio.
